General terms and conditions of sales

 

Preamble

 

The client accepts and acknowledges having read at the time the order is placed, these terms and conditions explicitly and unreservedly. They are automatically made available to the buyer on the start page of the website WYYNE.COM and at the bottom of the other pages under the name GTC.
These terms and conditions are governing the contractual relationship between WYYNE and the client, and the two parties are to accept them fully and without resevations.
These general sales conditions will prevail over all other conditions contained in any other document, unless agreed differently in writing.
If any provision of these conditions was void or annulled, the other clauses would not be so far cancelled. 

2 - Products

The photographs illustrating the products are not part of the contract.
If photo errors occur, shall in no case WYYNE be held responsable.
The products offered to its customers by WYYNE parties are in stock in its warehouse, the rest in those of its partners. 

 

3 - Order

The automatic registration systems are considered as proof of the nature, content and date of the order.
WYYNE confirms the acceptance of an order by e-mail to the e-mail address provided by the customer..
The sale will be concluded after the confirmation of the order.

WYYNE reserves the right to cancel any order from a customer with whom there is a dispute concerning payment of a previous order or for which payment could be subject to reservations.
The information stated by the buyer while passing an order commit him to not hold the seller responsible in case of errors in the wording of the details of the recipient that has led to impossibility to deliver, would occur.

4 -  Minimum quantity 

Some products will have a required minimum purchase quantity. This is clearly indicated on the site for each of these products. 

5 - Shipping - Transport

After confirmation of the order, WYYNE undertakes to deliver by TNT or LA POSTE the products ordered by the buyer within the period indicated on the product facts page on the website. The exception is when there is no more products in stock, regardless whether it is the stock of WYYNE or those of its partners.
TNT and LA POSTE are bound by a contract with WYYNE to deliver the order to the buyer's address provided by WYYNE.com, within

24 /  48-72 working hours respectively. 
Regarding deliveries outside of metropolitan France, the client accepts to pay all taxes due to the importation of products, customs duties, value added taxes and all other fees payable under the laws of the recipient country.
All orders placed with WYYNE are intended for the personal use of customers, clients or recipients of products.  The resale of Wyyne products, may it be partial or full is prohibited. WYYNE declines any legal responsibilities if the payment of necessary taxes or other fees were not made by the customer.
Delivery in France will be made by TNT or LA POSTE according to the choice of transportation made by the the customer.
Deliveries in the ECE countries and abroad are made by TNT.
A delay in delivery does not entitle the client to claim compensation for damages.
In the case of technical products such as wine accessories, the customer will pay particular attention to verify the proper functioning of the product delivered and to read the instructions provided with it.
In case of obvious defects, the buyer has the right to return the product as stipulated in these conditions.
WYYNE strives to meet delivery deadlines listed above.
These periods could be exceeded in cases of force majeure or circumstances beyond the control of WYYNE such as war, riots, fire, frost, flood, epidemic, strikes, accidents and the impossibility to be supplied.
WYYNE will inform the customer in good time, should cases and events listed above occur.
Any delay in delivery caused by a characteristic of force majeure or an act out of the control of WYYNE will have as result depending on what the customer chooses, either the complete annulation of the sale, or the acceptance of extended delivery times. Neither party can claim compensation. 
Timely delivery can only occur if the customer has fulfilled all his obligations towards WYYNE.COM
Goods are always travelling at the risk of the recipient, the transfer of risk always takes place when goods leave WYYNE warehouse. 
Always check your goods / products upon arrival. 
In case of missing or damaged goods, you have 48 hours to file a missing / damaged goods report, by mail, with the acknowledgement of receipt from the transporter included.
By reasons of availability, an order can be delivered to a customer at several occasions. 
In these cases the customer is however only charged one delivery.
If the client wishes two (2) places of delivery, he places two (2) orders with the delivery charges connected to eachother. 

6 - Rescission 

According to Article L. 121-16 of the Consumer Code, you can return at your expense, to our headquarters set out in Article 1, the product within seven (7) days after delivery, for exchange or refund, in good condition and in its original packaging with the original invoice attached.
Wine being a natural product, you have a period of seven days from reception of your order to send us a pro-forma request for exchange or cancellation and refund of your order. After this time it will be regarded as final.
WYYNE will not bear the cost of returning the order unless one of the following two conditions is met:
The delivered products are not the ones ordered , or you have made reservations with the transporter. If this is the case, please contact our customer service.
In case of annulation or withdrawal of the order, WYYNE is obliged to reimburse the client, without charge, except the cost of return.
Reimbursement is due within a maximum of 1 month.
After this period the sale will be regarded as concluded between the parties.

7 - Prices

All prices are quoted in euros.
The price of the product does not include transportation.
The price listed in the order confirmation is the final price, expressed with all taxes and VAT for France included. Prices are considered to be without taxes for the EEC countries.
The price includes the value of the product, its shipping and its storage costs. The price includes port charges for packaging and transport costs.
A detailed bill will accompany the delivery of your order. The bills are submitted in Euros (€)

8 - Payment

The price charged to the customer is the price indicated on the order confirmation sent by WYYNE.
The price of the products is payable in cash on the day of the order.
Payment is by credit card bearing the initials CB or by cheque or bank transfer.
Online payment module XXX lets you connect to a server via the bank BRED in a securitized environment.
Your credit card number is therefore directed to the servers of the bank directly, your payment is made to a bank in a secure environment without passing through the server of WYYNE. It guarantees that only our banking partner La Bred will access your credit card number.
The order validated by the client shall not be considered effective only when the bank payment centres concerned have given their approval.
In case of refusal by the payment centers, the order will automatically be cancelled and the customer notified by e-mail.
In addition, WYYNE reserves the right to refuse any order from a customer with whom there is a dispute, past or present. 

9 - Transfer of ownership

Until payment in full has taken place, WYYNE remains the owner of goods sold. The buyer is responsible for the goods once they leave WYYNE warehouse, transfer of risk takes place when goods leave WYYNE. 

10 - Guarantee

Concerning the wine accessories, WYYNE guarantees that all the selected products are manufactured or produced or edited for Europe and European conditions.
WYYNE is under no condition to be held liable for failure to comply with regulations and laws enforced in the recipient's country, the responsibility of WYYNE is limited to the value of the product in question, and the date of sale without any possibility of appeal to the brand name nor the manufacturer of the product.
The customer beneficiates from the legal guarantee of eviction and hidden defects (Art.1625 et seq of the Civil Code). 
Provided that the buyer has proof or evidence of a hidden defect, the seller is legally obliged to repair all its consequences (art.1641 et seq of the Civil Code) and, if the buyer has taken it to court, it must do so in a "promptly manner" after the discovery of the hidden defect (art.1648 Civil Code).

11 - Privacy, right of access and correction

In order to meet your needs and ensure a quality distance service, it is necessary for us to store certain personal data (names, addresses, phone numbers). You may receive tenders from WYYNE by e-mail, phone or possibly by post.
If you do not wish to receive them, just tell our customer service or log on at any moment to change your informations in the "My Account" section. 
Under the Data Protection Act of 6 January 1978, you have the right to access and correct data that has been stored about you. You can also have them corrected by contacting our customer service. 

12 - Disputes

13 - Legal Information

The informations and personal data that WYYNE asks for are required to submit, this information is essential for processing and delivering orders and for the establishment of invoices and contracts.
The non-submission of required informations leads to the non-validation of the order.
In accordance with the law "Informations and Liberties", the processing of personal data related to customers has been registered with the National Commission for Computing and Liberties (CNIL).
The customer has (Article 34 et seq of the Act of 6th January 1978) a right to access, modify, rectify and suppress the information concerning him. This right has priority over WYYNE.
Further, WYYNE will not communicate any customer information to third parties, nor suppress any details without the approval of the customer.

14 - Protection of Minors

In accordance with Article L. 3342-1 of the Public Health Code, which stipulates that the sale of alcohol to minors under sixteen (16) years of age is prohibited, you agree, by completing the purchase order, to being sixteen (16) years of age or above on the date of the order by checking the appropriate box.
